Terms of Service

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract to use Plancast. By using the service you represent that you meet these requirements.

2. What Plancast does

Plancast is a tool that lets you upload a garden or planting plan, calibrate its real-world scale, and project it onto the ground through your phone’s camera using augmented reality (AR), so you can trace planting lines and positions in place. Features and behavior may change over time.

3. Your account

Accounts are created and authenticated through our identity provider (Clerk), including optional Google sign-in. You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly if you suspect unauthorized use.

4. Subscriptions, free trial, and billing

• Monthly plan ($9.99/month). Includes a 7-day free trial. A payment method is required up front. Unless you cancel before the trial ends, we (through Stripe) automatically charge the monthly fee at the end of the trial and then each month until you cancel.
• Annual plan ($94.99/year). Charged immediately when you subscribe, with no free trial, and renews annually until you cancel.
• Auto-renewal. Subscriptions renew automatically at the then-current price for the applicable period. By subscribing you authorize these recurring charges.
• Cancellation. You can cancel anytime from your account’s billing portal. Cancellation stops future charges; your access continues until the end of the period you have already paid for (or, for a trial, until the trial ends).
• Price changes. We may change prices; we will give you reasonable advance notice, and changes apply to renewals after the notice period.
• Taxes. Prices exclude taxes unless stated; you are responsible for any applicable taxes.

5. Refunds

The free trial is there to let you evaluate Plancast at no charge. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods, unused time, or amounts already charged.

6. Acceptable use

You agree not to:

• Use the service unlawfully or in violation of these Terms;
• Copy, resell, sublicense, or provide the service to third parties as your own;
• Reverse engineer, decompile, or attempt to extract source code, except where that restriction is prohibited by law;
• Interfere with, overload, or disrupt the service or its infrastructure, or attempt to bypass usage limits or security;
• Upload content you don't have the rights to, or that infringes others' rights or is unlawful.

7. Your content

You keep ownership of the plans, images, and other materials you upload (“Your Content”). You grant us a limited, worldwide, royalty-free license to host, process, and display Your Content solely to operate and provide the service to you (for example, to generate your AR overlay). You are responsible for having the rights to everything you upload.

8. Our intellectual property

Plancast, including its software, design, and content (excluding Your Content), is owned by Ecoplantia and protected by intellectual-property laws. Patent Pending. We grant you a limited, non-exclusive, non-transferable, revocable license to use the service for its intended purpose while your subscription is active. No other rights are granted.

9. AR accuracy and safety — please read

Plancast uses augmented reality and your device’s sensors to approximate where your plan falls on the ground. Positions, scale, and alignment are estimates and can be affected by lighting, surface, device capabilities, and how you calibrate. Do not rely on Plancast as a substitute for professional surveying, utility-locating, or precise measurement.

You are responsible for your own safety and surroundings while using the service. Stay aware of your environment, watch for hazards (traffic, drop-offs, tools, other people), and do not use the app while driving or in unsafe conditions. Before digging, follow local requirements to locate underground utilities.

10. Third-party services

Plancast relies on third parties to function — including Clerk (accounts), Stripe (payments), Vercel (hosting), and AR components such as Variant Launch (WebXR on iOS) and Apple AR Quick Look. Your use of those features may also be subject to the third party’s terms. We are not responsible for third-party services.

11. Disclaimer of warranties

The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or accurate.

12. Limitation of liability

To the maximum extent permitted by law, Ecoplantia and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the service will not exceed the amount you paid us for the service in the twelve (12) months before the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold Ecoplantia harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your use of the service, Your Content, or your violation of these Terms or applicable law.

14. Termination

You may stop using the service and cancel at any time. We may suspend or terminate your access if you violate these Terms or to protect the service or other users. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Your continued use of the service after changes take effect means you accept the revised Terms.

16. Governing law

These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located there for any dispute not subject to other agreed dispute-resolution terms.
